Terms and Conditions

These Terms and Conditions apply to the purchase of goods from CZ-THERM s.r.o. via the online shop at profiobklady.cz, by e-mail or by phone. They are issued by the seller pursuant to Section 1751 et seq. of Act No. 89/2012 Coll., the Civil Code. The seller sells to business customers, i.e. companies and sole traders, as well as to consumers from the Czech Republic and Slovakia. Provisions that apply only to consumers or only to business customers are expressly marked as such.

1. Seller

The seller is CZ-THERM s.r.o., with its registered office at Bartošova 5532, 760 01 Zlín, Czech Republic, Company ID (IČO) 21503761, VAT ID (DIČ) CZ21503761, registered in the Commercial Register kept by the Regional Court in Brno, Section C, File 139188 (hereinafter the “seller”).

Contact: e-mail info@profiobklady.cz, phone +420 737 246 887, address for service of documents: Bartošova 5532, 760 01 Zlín.

2. Buyer and Introductory Provisions

  • The buyer may be a business with its registered office or place of business in the Czech Republic or Slovakia that purchases in the course of its business: a company (for example, an s.r.o. or a.s.) or a self-employed individual operating under a trade licence (sole trader).
  • The buyer may also be a consumer, i.e. an individual purchasing outside the scope of their business (hereinafter the “consumer”).
  • A business customer states in the order its business name or name, Company ID (IČO) and, if VAT-registered, also its VAT ID (DIČ). By providing the Company ID, it confirms that it is purchasing as a business. A consumer states their first name and surname, address, e-mail and phone.
  • If the buyer is a consumer, consumer protection provisions also apply in addition to these terms, in particular those of the Civil Code and Act No. 634/1992 Coll., on Consumer Protection. Provisions of these terms that would curtail the consumer's statutory rights do not apply to the consumer.
  • The Terms and Conditions form an integral part of the purchase contract. Deviating arrangements in the purchase contract take precedence over these terms. The contract and the Terms and Conditions are concluded in the Czech language.

3. Goods, Prices and Shipping

  • Information about the goods, their main characteristics, price, packaging and availability is given for each item on the website. The presentation of goods is for information only and does not constitute a binding offer by the seller to conclude a contract.
  • Prices on the website are stated in Czech crowns excl. VAT, and each price is also shown incl. VAT (at the 21 % rate applicable in the Czech Republic). Prices include packaging. Consumers and any buyer charged VAT by the seller pay the price incl. VAT shown in the order summary. The amount in euros is only an approximate conversion at a rate of 25 Kč to 1 €. However, for delivery to Slovakia, the amount in euros shown in the order summary is paid.
  • The seller charges VAT in accordance with the VAT Act. For a VAT-registered business buyer from Slovakia who provides a valid VAT number (IČ DPH), the seller invoices the supply of goods to another Member State without Czech VAT, provided the statutory conditions are met. Consumers and buyers without a valid VAT number are always charged VAT: 21 % for delivery in the Czech Republic and 23 % (the Slovak VAT rate) where both the billing address and the delivery address are in Slovakia. The rate applied and the amount of VAT are always shown in the order summary before the order is sent.
  • Shipping within the Czech Republic and Slovakia is free for orders from 5 000 Kč excl. VAT (6 050 Kč incl. VAT). For levelling clips and anti-pigeon spike strips, shipping is always free, with no minimum, provided the order contains no other goods. For orders under 5 000 Kč excl. VAT that contain a shower drain or a floor drain, the seller charges a shipping fee of 250 Kč excl. VAT (302.50 Kč incl. VAT). For other orders under 5 000 Kč excl. VAT, the seller charges a shipping fee of 200 Kč excl. VAT (242 Kč incl. VAT). The shipping price is always shown in the order summary before the order is sent. Details are on the Shipping and Payment page.
  • The seller may change prices on the website. A change does not affect orders it has already confirmed. Prices are valid for as long as they are displayed on the website.

4. Order and Conclusion of the Contract

  • The buyer orders goods via the cart on the website, or enquires about them using the form on the website, by e-mail or by phone. Ordering via the cart is possible without registration.
  • When ordering via the cart, the buyer selects the goods and their quantity, chooses whether they are buying as a company or as a private individual, fills in the billing and delivery details and chooses the payment method. Before sending, the buyer can check and correct all details in the order summary. The buyer sends the order using the “Order with obligation to pay” button after confirming that they have read these Terms and Conditions.
  • After the order is sent, the seller will, without undue delay, send the buyer an automatic e-mail confirmation that the order has been received. This confirmation does not constitute acceptance of the order. The purchase contract is concluded when the seller confirms the order (the “We confirm your order” e-mail), at the latest when the goods are dispatched, or when the buyer accepts the seller's offer.
  • The buyer may cancel the order by e-mail or phone as long as the seller has neither confirmed it nor dispatched the goods.
  • The seller may reject an order, in particular if the goods are unavailable or the price on the website was obviously incorrect. If the seller cannot fulfil any requirement of the order, it will send the buyer an amended offer, and the contract is then concluded when the buyer accepts it.
  • The costs of means of distance communication (internet, phone) when concluding the contract are borne by the buyer and do not differ from the standard rate.
  • The seller archives the concluded contract in electronic form and makes it available to the buyer on request.
  • Painted trims, shower shelves sprayed to order, goods marked “made to order” and other goods made to the buyer's specifications are only produced by the seller once an order has been placed. The minimum order quantity and delivery times are stated for each item. The seller may require a deposit for such goods. Whether it is possible to withdraw from the contract for goods made to the consumer's specifications is governed by Article 7.

5. Payment Terms

  • When ordering via the cart on the website, the buyer chooses cash on delivery on receipt of the shipment or payment by invoice via bank transfer. Otherwise, the buyer pays the purchase price by bank transfer on the basis of a proforma invoice or an invoice, or by another method stated in the order confirmation.
  • For cash on delivery, the purchase price is payable on receipt of the goods. For payment by invoice, the seller sends the buyer the invoice by e-mail, and the due date is stated on the invoice. The seller may require payment before the goods are dispatched, which it will state in the order confirmation.
  • The purchase price is paid when the amount is credited to the seller's account, or for cash on delivery when it is paid to the carrier. Together with the purchase price, the buyer pays the shipping fee in the amount shown in the order summary.
  • The seller sends the tax document to the buyer by e-mail.
  • Ownership of the goods passes to the buyer upon payment of the full purchase price, but not before receipt of the goods.
  • In the event of late payment, the seller may charge statutory default interest and suspend further deliveries until payment is made.

6. Delivery of Goods and Availability

  • Availability is shown for each item on the website and in the cart: “In stock, ready for immediate delivery” means the goods are in stock and the seller usually dispatches them within 24 hours, at the latest on the following working day; “In stock at an external supplier, delivery within 14 days” means delivery within 14 days. The periods run from acceptance of the order, or for advance payment from the date the payment is credited. The seller will state the specific date in the order confirmation.
  • The seller delivers goods within the Czech Republic and Slovakia via the carrier TOPTRANS or GEIS (depending on the type and size of the shipment) to the address given in the order, or personal collection is possible by agreement. Painted trims are delivered approximately 2–3 weeks after ordering.
  • The buyer is obliged to accept the goods. On receipt, the buyer checks that the packaging is intact and the number of packs is correct. A damaged shipment must be recorded in the carrier's report, or refused, and the seller informed without undue delay.
  • If the seller has to redeliver for reasons attributable to the buyer, the buyer shall bear the costs of redelivery.
  • The risk of damage to the goods passes to a business buyer when the goods are handed over to the first carrier, to a consumer when the goods are received from the carrier, and in the case of personal collection when the goods are collected.

7. Withdrawal from the Contract and Return of Goods

Consumer

  • The consumer has the right to withdraw from a distance contract without giving a reason within 14 days of receiving the goods, or for deliveries in several parts, of receiving the last part. The time limit is met if the consumer sends the notice of withdrawal before it expires.
  • The consumer gives notice of withdrawal using the online form on the Withdrawal from the Contract page (the “Confirm withdrawal from the contract” button), by e-mail to info@profiobklady.cz or by letter to the seller's registered office address. The consumer may use the model form below, but is not obliged to. The seller will confirm receipt of the notice without undue delay.
  • After the online form is sent, the seller immediately sends an e-mail with a copy of the notice and the date and time of its receipt, which serves as confirmation on a durable medium. The detailed procedure for returning goods and refunds is on the Withdrawal from the Contract page.
  • The consumer returns the goods to the seller within 14 days of withdrawal at the latest, undamaged and, if possible, in the original packaging. The direct costs of returning the goods are borne by the consumer. For goods that, by their nature, cannot be returned by normal post (for example, trims longer than 2 m, pallets or large-format slabs), the consumer bears the transport costs, the amount of which the seller will communicate in advance on request.
  • The seller will refund the consumer all money received, including delivery costs, except for additional costs for a delivery method other than the cheapest one offered, within 14 days of withdrawal, using the same method by which it was received or otherwise as agreed with the consumer. The seller is not obliged to refund the money before the consumer hands over the goods or proves that they have been sent.
  • The consumer is liable for any reduction in the value of the goods resulting from handling them other than as necessary to establish their nature, characteristics and functioning.
  • It is not possible to withdraw from the contract for goods made or modified to the consumer's specifications or for them personally (Section 1837(d) of the Civil Code). This refers to goods made or modified only on the basis of an order according to the consumer's individual requirements, in particular shower shelves sprayed to order, goods in the Custom RAL shade, goods cut to the required size and goods expressly marked “made to order” in the offer. The mere fact that goods are painted does not remove the right of withdrawal. Other cases in which withdrawal is not possible are set out in Section 1837 of the Civil Code.

Business customer

  • A business buyer has no statutory right to withdraw from the contract without giving a reason.
  • Undamaged goods may be returned only by prior agreement with the seller. The goods must be unused and in their original intact packaging. The seller may charge transport costs and a handling fee, the amount of which it will communicate in advance.
  • Goods made or modified to order (for example, goods marked “made to order”) cannot be returned.

  • Rights arising from defective performance are governed by the Civil Code, for business customers Sections 2099 to 2117, for consumers additionally Sections 2158 to 2174b, and by the Consumer Protection Act.
  • For business customers: the business buyer checks the goods as soon as possible after receipt. It notifies the seller of obvious defects and incorrect quantities without undue delay. • The consumer may claim a defect if it appears within 2 years of receiving the goods.
  • The buyer makes a complaint using the form on the Complaints Procedure page, by e-mail to info@profiobklady.cz or at the seller's registered office. The detailed procedure is described in the Complaints Procedure. The buyer attaches a description of the defect, photos and the invoice number. The seller handles the complaint without undue delay, usually within 30 days, and informs the buyer of the result. The seller handles a consumer's complaint within 30 days of its submission at the latest, unless a longer period is agreed with the consumer, and issues the consumer a confirmation of when the complaint was made, what it concerns and what method of resolution is requested, as well as a confirmation of the date and method of resolution of the complaint.
  • For business customers: if the complaint is justified, the seller will, depending on the nature of the defect, replace the goods, repair them, grant a discount or refund the purchase price, as provided by the Civil Code. In the case of a justified complaint, the buyer is entitled to reimbursement of costs reasonably incurred.
  • For consumers: a consumer does not lose rights arising from defective performance by not inspecting the goods on receipt, but we recommend checking the goods as soon as possible. The choice of rights arising from defective performance, time limits and the handling of consumer complaints are governed by the Complaints Procedure (Articles 3, 6 and 7) and the Civil Code.
  • The seller is not liable for wear and tear of the goods from normal use or for defects caused by improper installation, storage or damage after receipt, nor for a defect of which the buyer was aware before receipt or which the buyer caused.

9. Personal Data Protection

How the seller processes the personal data of buyers and contact persons is described on the Personal Data Protection page.

10. Delivery of Documents

The contracting parties serve documents on each other primarily by e-mail. The buyer sends documents to the seller at info@profiobklady.cz, and the seller to the buyer at the e-mail address given in the order.

11. Out-of-Court Resolution of Consumer Disputes

  • If a consumer dispute arises between the seller and the consumer under the purchase contract that cannot be resolved by mutual agreement, the consumer may submit a petition for out-of-court resolution of such a dispute to the designated out-of-court consumer dispute resolution body, which is the Czech Trade Inspection Authority, Central Inspectorate – ADR Department, Gorazdova 1969/24, 120 00 Praha 2, e-mail adr@coi.gov.cz, website coi.gov.cz/informace-o-adr.
  • A petition may be filed no later than 1 year from the day on which the consumer first asserted the right in dispute with the seller. The consumer should first contact the seller, for example with a complaint or by e-mail to info@profiobklady.cz.
  • A consumer from another EU Member State, for example Slovakia, may also contact the European Consumer Centre Czech Republic, www.evropskyspotrebitel.cz.

12. Supervision

The seller is authorised to sell goods on the basis of a trade licence. Trade licensing supervision is carried out by the competent Trade Licensing Office within its remit. Compliance with the Consumer Protection Act is supervised to the defined extent by the Czech Trade Inspection Authority (coi.gov.cz), and personal data protection by the Office for Personal Data Protection (uoou.gov.cz).

13. Final Provisions

  • Contracts are governed by the law of the Czech Republic, including for buyers from Slovakia. This does not deprive the consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
  • The UN Convention on Contracts for the International Sale of Goods (Vienna Convention) does not apply to contracts with business customers from Slovakia and other countries.
  • In relation to the buyer, the seller is not bound by any codes of conduct within the meaning of Section 1826(1)(e) of the Civil Code.
  • In relation to business customers, Sections 1799 and 1800 of the Civil Code on adhesion contracts do not apply.
  • Disputes with business customers are decided by the court with subject-matter jurisdiction according to the seller's registered office.
  • The seller may change these terms. The terms valid on the day the contract is concluded apply to the contract.
  • These terms are effective from 22 October 2026.
